INCORPORATION AND TAX EXEMPTION ASSISTANCE

Winters & King, Inc. has built a nationwide reputation as a trusted advisor and advocate for all kinds of religious, charitable and philanthropic organizations. We have represented literally thousands of nonprofit organizations throughout the United States, including many well-known and highly respected ministries, television networks, universities and many other kinds of religious organizations.

Incorporation

The first step in beginning a church or ministry is to create the entity itself.  We will take care of the entire process for you by drafting and filing Articles of Incorporation with your state, obtaining a taxpayer number, drafting Bylaws, and drafting the minutes of your first meeting.  When we are done you will have everything you need to hit the ground running and start engaging in activities.  The process can be completed in as little as 48 hours.

IRS Application for 501(c)(3) Status

One of the wonderful benefits available to a nonprofit organization is having tax exempt status. However, most nonprofits must apply to receive this benefit. An application for 501(c)(3) status can be a lengthy and confusing process. Winters & King, Inc. has represented thousands of ministries and churches in attaining 501(c)(3) exemption and would be privileged to help you as well.

Making a complex process simple through experienced representation

Through decades of experience in applying for 501(c)(3) status, Winters & King, Inc. has developed a system to help churches and ministries attain tax exemption with as little effort on your part as possible. Our process helps identify red flags before the application is filed and our knowledgeable attorneys advise you on how to operate your nonprofit in compliance with IRS and governmental regulations. The IRS has several options for organizations to apply for tax exempt status including Form 1023, Form 1023-EZ, Form 1024, etc. We can advise you on which type of exemption you qualify for and what application to use.

Winters & King, Inc. has specialized questionnaires covering key areas of IRS interest for different types of organizations. We have identified common follow up questions received from the IRS and incorporated them into our questionnaires to avoid delays in the application process and identify operational issues in the initial stages of organizing your church or ministry. Sometimes the IRS has further questions about an organization. When an inquiry is received, our firm handles all correspondence with the IRS and all responses are covered in the flat fee quoted at the beginning of the process.  We believe it is in everyone’s best interest to know what the out of pocket costs will be for the tax exemption process from the very beginning. You can rest easy knowing that our flat fee will not result in surprise bills no matter how much time we spend helping you through the process.

Reinstatement of 501(c)(3) Status

At times, organizations (excluding churches) may have their tax exempt status revoked if they fail to file annual returns for three consecutive years. When this happens, our firm can assist you in the process of reinstating your tax exemption. We charge a flat fee to get you back in good standing with the IRS and if your application is filed within 15 months of your revocation we can usually avoid any gap in your tax exemption.  A timely reinstatement of your 501(c)(3) status avoids the many problems associated with donations and other income received during any period your 501(c)(3) status was revoked.
